Please read these Terms & Conditions carefully before making a booking with us. By booking with us or using this website, you confirm that you have read, understood and accepted them. If you do not agree, please do not use this website or make a booking.
1. About Us
This website, traveltoharam.co.uk, is owned and operated by HOLIDAYS HUB LIMITED, trading as Travel To Haram a company registered in England and Wales under company number , with its registered office at 156 Great Charles Street Queensway Birmingham West Midlands, West Midlands B3 3HN.
“You” and “your” mean the person making the booking and every person named on the booking.
2. ATOL Financial Protection
Many of the flights and flight-inclusive holidays on this website are financially protected by the ATOL scheme. ATOL protection does not apply to all travel services listed on this website. Please ask us to confirm what protection applies to your booking.
If you do not receive an ATOL Certificate, your booking is not ATOL protected. If you receive an ATOL Certificate but some parts of your trip are not listed on it, those parts are not ATOL protected.
When you buy an ATOL-protected flight or flight-inclusive holiday from us, you will receive an ATOL Certificate. It lists what is financially protected, where you can get more information, and who to contact if things go wrong.
We, or the suppliers named on your ATOL Certificate, will provide the services listed on it (or a suitable alternative). If neither we nor the supplier can do so because of insolvency, an alternative ATOL holder may provide the services you bought, or a suitable alternative, at no extra cost to you. In that case you agree to accept the alternative ATOL holder and to pay any outstanding money due under your contract to them. If no alternative ATOL holder can be appointed, you may claim under the ATOL scheme (or from your credit card issuer, where applicable).
If a payment is made to you under the ATOL scheme, you agree to assign to the Trustees of the Air Travel Trust any claims you have relating to the non-provision of the services, including any claim against us, the travel agent or your credit card issuer. These claims may be reassigned to another body that has paid sums you claimed under the scheme.
For more information, visit www.atol.org.uk.
3. Our Role
We act as agent: Where we act only as an agent, we arrange flights, accommodation, transport and related services on behalf of the airline, hotel or other supplier (the “Principal”). Your contract is with the Principal, and the Principal’s own terms and conditions apply to your booking. We do not have authority to change the Principal’s terms in your favour. We are not liable for the acts, omissions or failures of the Principal, but we will pass on any complaint on your behalf and help you as far as we reasonably can.
Your booking confirmation will state clearly who your contract is with.
4. Making a Booking
- Your booking is confirmed only when we have received the required deposit and have sent you a written confirmation (by email or otherwise). A telephone booking, once confirmed by us, is as binding as a written one.
- The person making the booking is responsible for paying the total price for everyone named on the booking, and confirms that they have the authority to accept these Terms on behalf of all passengers.
- Please check your confirmation, invoice and all later documents carefully as soon as you receive them. Tell us immediately about anything that is missing or incorrect, especially names, which must match passports exactly. Correcting errors may incur airline or supplier charges.
- We provide details of flights, hotels and services in good faith, based on information from our suppliers at the time of booking. If any detail changes, we will inform you promptly.
5. Deposit and Payment
- Your booking will only be confirmed once all required booking details and arrangements have been completed and confirmed by our team.
- The balance must be paid by the due date shown on your confirmation. For some bookings, particularly those made close to departure, or those involving scheduled flights, full payment may be required immediately. We will tell you at the time of booking.
- If you do not pay the balance on time, we may treat your booking as cancelled by you, and the cancellation charges in Section 8 will apply.
6. Prices
- Deposit and price: Paying a deposit does not by itself guarantee your seat or the price. Airlines and suppliers may change their fares until full payment is made and the tickets are issued.
- Price changes: After you have booked, we may increase the price only to reflect changes in the cost of fuel or other power sources, taxes or fees (such as airport or landing charges) imposed by third parties, or exchange rates. We will not increase the price in the 20 days before departure. If an increase is more than 8% of the total price, you may accept it, accept an alternative package if we offer one, or cancel and receive a full refund. Where we reduce a price for the same reasons, we will refund any overpayment, less our actual administrative costs.
- Government action: Prices may change because of direct government action, such as the introduction of, or increase in, VAT, passenger levies or taxes.
- Group bookings: Some packages depend on a minimum number of travellers. If the group is smaller than planned, we may need to increase the price, or cancel as set out in Section 9.
7. Changes You Make to Your Booking
- To change your booking (for example dates, hotel, passenger names or departure airport), you must contact us in writing. We will try to accommodate your request, but we cannot guarantee it.
- Changes to a booking may be subject to amendment charges, along with any additional fees imposed by airlines, hotels, or other suppliers. We will inform you of the total cost before making any requested changes. Airline name-change rules may be strict, and certain tickets may not be changeable or refundable.
- Adding extra travellers to an existing booking is treated as a new booking and is subject to availability and current prices.
- Additional taxes may sometimes be payable. We will tell you before tickets are issued.
- If you cannot travel, you may be able to transfer your package to another person who meets all the conditions, provided you give us reasonable notice, at the latest 7 days before departure. You and the new traveller will be jointly responsible for paying the balance and any transfer costs.
8. Cancellation by You
- You must notify us of a cancellation in writing. The person who made the booking is responsible for the cancellation charges for all travellers. Charges are calculated from the date we receive your written notice.
- Cancellation charges, as a percentage of the total holiday cost, are:
Days before departure | Cancellation charge |
More than 42 days | Loss of deposit |
29 to 42 days | 50% |
15 to 28 days | 70% |
8 to 14 days | 90% |
0 to 7 days (including no-show) | 100% |
- After tickets are issued, cancellation will result in a loss of 100% of the cost of all travel arrangements in most cases. Bookings on charter flights carry a 100% cancellation charge both before and after ticket issue. Please speak to your travel adviser before cancelling.
- Charges are based on the costs we cannot recover from airlines, hotels and other suppliers. Any refund due will be paid within 14 days of your cancellation being processed.
- If your visa is refused, or you are unable to travel for any personal reason, the charges above still apply. Please see Section 17 (Insurance).
9. Changes and Cancellation by Us
Minor changes. Sometimes we must make small changes to your arrangements. We will tell you as soon as possible. You will not normally be entitled to compensation for minor changes.
Major changes. A major change includes a change of more than 12 hours to your departure time, a change of airport (other than between London-area airports), a change of hotel to one of a materially lower standard, or any other significant change to an essential part of your booking. Where we are forced to make one, we will tell you as soon as possible. You may then:
- accept the change;
- accept an alternative package of similar or higher quality if we offer one; or
- cancel and receive a full refund of all monies paid to us for the affected booking.
Cancellation by us. We may cancel your booking if:
- the minimum group size for your package is not reached (we will notify you at least 28 days before departure and refund you in full); or
- we are prevented from performing the contract by unavoidable and extraordinary circumstances (see Section 16).
If we cancel for any reason other than your breach of these Terms, we will refund all monies you have paid. Where the law entitles you to compensation, we will pay it.
10. Flights
- Airline names, flight numbers, timings and airports are shown on your confirmation or ticket. They are subject to change by the airline, and we cannot guarantee a particular airline or aircraft type.
- Reconfirmation: You are responsible for checking your flight times before departure, and, if the airline requires it, reconfirming your flights at least 72 hours before departure. We are not liable for costs caused by your failure to do so.
- Airlines set their own baggage allowances, check-in rules and conditions of carriage, which apply to you. Please check them before you travel.
- The airline’s conditions of carriage apply to any delay, denied boarding or loss of baggage. Where UK or EU passenger-rights rules apply, you may claim compensation directly from the airline.
11. Visas, Passports and Entry Requirements
- You are responsible for making sure that you and everyone in your party hold the correct, valid passport, visa and any other documents required for travel.
- Your passport must normally be valid for at least six months after your intended date of return, and must have sufficient blank pages. Requirements can change, so please check well before you travel.
- Umrah and Hajj visas: Visas are issued by the Kingdom of Saudi Arabia and its authorities, not by us. Where we offer visa services, we submit applications on your behalf, based on the documents you give us. We cannot guarantee that a visa will be granted, nor how long it will take. Processing times, fees, systems (including the Nusuk platform) and eligibility rules are set by the Saudi authorities and may change without notice.
- If your visa is refused or delayed for any reason, including incomplete or incorrect documents, you will still be liable for cancellation charges as set out in Section 8, less any visa fee refunded to us by the authorities.
- Women and minors: Saudi Arabia has specific rules on travel for women and for children, which may change. Please check the current requirements with us or the Saudi authorities before booking.
- Information for British citizens is available at gov.uk/foreign-travel-advice. Citizens of other countries should contact the relevant embassy or consulate.
- We accept no liability if you are refused boarding or entry to any country because you do not have the correct documents.
12. Health Requirements
- You are responsible for checking the health and vaccination requirements for your trip and for obtaining all recommended vaccinations and medication. Saudi Arabia requires certain vaccinations (for example, meningitis) for Umrah and Hajj pilgrims, and requirements may change.
- Please consult your GP or a travel clinic well before departure. Current advice is available from NHS Fit for Travel (fitfortravel.nhs.uk) and TravelHealthPro (travelhealthpro.org.uk).
- Umrah and Hajj involve a lot of walking, heat and crowds. Please make sure you are fit to travel and to perform the rituals.
13. Accommodation and Transport
- Hotel star ratings are those given by local authorities or the hotel, and may differ from UK standards.
- Distances from hotels to Masjid al-Haram and Masjid an-Nabawi are approximate and are based on information from the hotel or supplier. Walking distance and travel time can vary depending on crowds, security arrangements and road closures.
- Room types and bed configurations depend on availability, and check-in and check-out times are set by the hotel. Early check-in and late check-out cannot be guaranteed.
- Transport, including transfers, coaches and internal flights or trains, is provided as described in your package. Timings may be affected by traffic, security measures, crowd control and weather.
- During peak periods such as Ramadan, Hajj season and school holidays, services in Makkah and Madinah are extremely busy. We will always try to keep disruption to a minimum, but cannot control it.
- Ziyarat and additional tours: If included, itineraries may be changed or cancelled by the operator because of local conditions, weather or restrictions.
14. Special Requests and Medical Conditions
- Please tell us about any special requests (for example, adjoining rooms or dietary needs) when you book. We will pass them on to the relevant supplier, but cannot guarantee they will be met. A special request that is not met is not a breach of contract.
- If you or anyone in your party has a medical condition or disability that could affect your trip, you must tell us in writing at the time of booking and give full details. If we cannot reasonably meet your needs, we may decline or cancel the booking and, where appropriate, refund you.
15. Conduct
- You are responsible for any damage or loss caused by you or any member of your party. You must pay for it directly to the accommodation or supplier concerned. If you do not, you must reimburse us for any claim (including legal costs) made against us as a result.
- You must respect the laws, customs and religious rules of Saudi Arabia and of every place you visit, including the rules of the Two Holy Mosques.
- If, in our reasonable opinion or that of any person in authority, your behaviour causes or is likely to cause danger, distress or annoyance to others, or damage to property, we may end your arrangements without notice. In that case we will have no further responsibility to you, including for return transport, and will not be liable for any refund, costs or compensation.
16. Unavoidable and Extraordinary Circumstances (Force Majeure)
We are not responsible for any loss, damage, delay or change to your arrangements caused by events beyond our control which could not have been avoided even if all reasonable care had been taken. Examples include war, civil unrest, terrorism, industrial action, epidemics or pandemics, government restrictions, natural or nuclear disaster, fire, severe weather, airport or border closures, and cancellation or changes of schedules by airlines.
If such an event affects your trip, we will help you as far as we reasonably can and, where the law requires, provide a refund
17. Insurance
We strongly recommend that everyone travelling has adequate travel insurance, including cover for cancellation, medical expenses, repatriation and loss of baggage, which covers the type of trip you are taking. Please read the policy carefully to check it suits your needs. If you decline the insurance we offer, we may ask you to sign an indemnity form confirming that you have travelled uninsured at your own risk.
“If you arrange or sell insurance, state your FCA status and the 14-day cooling-off period for policies here. If you do not sell insurance, delete this sentence and the reference to “the insurance we offer” above.”
18. Our Liability
- We will accept responsibility for the proper performance of the services we are contracted to provide, as required by law and as set out in Section 3.
- Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law.
- Otherwise, we are not liable for any loss which was not a reasonably foreseeable result of our breach, or for any business losses.
- We are not responsible for the actions of third parties who are not our suppliers, or for services and excursions you arrange yourself during your trip.
19. Complaints
If you have a problem during your trip, please tell your local representative or the relevant supplier immediately so that it can be put right on the spot. If it is not resolved, please contact us on +442033554383 or at info@traveltoharam.co.uk.
If you wish to make a formal complaint after your return, please write to us within 28 days of the end of your trip, with your booking reference and full details. We will respond within “28” days.
20. Documents
Your travel documents will normally be sent by email about 7 days before departure. If you book within 14 days of departure, documents may be sent by email or collected at the airport. Please check them immediately and tell us about any errors.
21. Privacy and Data Protection
We collect and use your personal information, including passport and health details where necessary, only to arrange your travel, obtain visas and comply with the law. We may need to share it with airlines, hotels, visa agents and authorities in the countries you are travelling to. Please see our Privacy Policy for full details of how we use your data and your rights.
22. Website Use
We try to keep the information on this website accurate and up to date, but it may occasionally contain errors, and prices and availability may change without notice. Your booking is not final until we confirm it. All content on this website belongs to us or our licensors and may not be copied without our permission.
23. Changes to These Terms
We may update these Terms from time to time. The Terms that apply to your booking are those published on the day you made it.
24. Governing Law
These Terms and your booking are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you may bring proceedings in the courts of the part of the UK where you live. Otherwise, the courts of England and Wales have jurisdiction.
